    Fundamental Rights application: SC issues notice on SLMC

    The Supreme Court yesterday issued notice on the Sri Lanka Medical Council (SLMC) and its registrar in connection with a fundamental rights application filed by the Society of Registered and Assistant Medical Officers (SRAMO) complaining that the Council has de-recognised medical degrees awarded by a Russian medical institute.

    Filing the petition, a Russian medical degree holder complained that the introduction of a condition has caused irreparable loss and damage to the Registered and Assistant Medical Officers holding degrees from Sít Petersburg State Medical Academy and those going to sit for the Examination for Registration to Practice Medicine.

    They cited the SLMC, its Registrar, and Attorney General as respondents.

    The petitioner obtained a Medical Degree from Sít Petersburg State Medical Academy and was entitled to be a medical practitioner in terms of the medical ordinance.

    The petitioner stated, to obtain a qualification as an Assistant Medical Officer one has to follow an intensive course of two-and-half-years to three years conducted by the Medical Faculties of the Universities of Colombo, Jaffna, Peradeniya, and the National Institute of Health Services, Kalutara. Having successfully followed the courses, the candidates serve mandatory internship conducted by the Department of Health Services and various hospitals and sit for the Examination for Registration to Practice Medicine.

    The Petitioner contended that the Registered Medical Officers perform the same duties as those having MBBS qualifications and allocated to the same position.

    The petitioner claimed that SLMC wrongfully contended the petitioner had not followed a five-year or six-year course at the Sít Petersburg State Medical Academy and he complained that the time period was irrelevant.

    He further said the Court of Appeal in a previous judgement accepted the degree awarded by the said Russian medical institute.

    Despite courts ruling, the Medical Council refused to recognise the Medical Degree awarded by the foreign university.

    He complained that the SLMC called for applications from candidates to sit for the Examination for Registration to Practice Medicine and for the first time a condition has been introduced to obtain a MBBS or an equivalent degree from a foreign medical school recognised by the SLMC after following a course not less than five years.

    The petitioner stated that this condition of over five years was imposed to exclude the members of the SRAMO and Registered Medical Officers from applying for the said examination.

    The petitioner complained that the said insertion of the condition was ultra vires, contrary to the Medical Ordinance and in violation of the fundamental rights of the petitioner. He also claimed the SLMC has no power to de-recognise the Medical Degree awarded to him and others.

    He asked court to grant a leave to proceed order directing the SLMC to permit the Registered Medical Officers possessing the MD Degree from the Russian school to sit for the Examination for Registration to Practice Medicine and interim order preventing the SLMC from conducting the examination on May 26, 2007.

    I don't care about Srilanka, I think this is just a political game.Fomerly, Srilanka wanted to seperate from India but Russia didn't want. This is just a consequence of the contradiction between two countries.
    Srilanka is not a beautifull land for medical student, Civil wars happen daily here.
