Note that copyright law does not restrict resale of copies of works, provided those copies were made by or with the permission of the copyright holder. Thus it is legal, for example, to resell a book or a CD that you have purchased, provided you do not keep a copy for yourself. In the United States this is known as the first-sale doctrine, and was established in the U.S. court system to clarify the legality of reselling books in used book stores. Elsewhere it has other names; in the United Kingdom it is known as "exhaustion of rights" and is a principle which applies to other intellectual property rights.


Kaplan class notes are never "purchased" by the students. Rather, they are part of the live courses, just as the slides, etc. The notes are not sold separately and are intended to be used only as part of the course. In this sense, the notes do not belong to the students because technically Kaplan still owns them and only sort of lends them to the students. It's similar to Kaplan Qbank where you purchase access to the questions for a certain time period, but reproducing them is not permitted.

KAPLAN DOES NOT ALLOW THE REPRODUCTION OR SELLING OF THEIR PRODUCT.

so if you buy the course and get the books you are saying you can't resell them? There is a ton of them for sale on ebay all the time. If they are lending them to you why do you have to pay almost 4000. for the video course.

Kaplan is making a concious effort to have all ebay Kaplan notes (at least their live lecture notes) pulled. Some ppl will post but they are often removed within a day or two. Older edition and the home study guides seem to have a beter chance of staying on. Alternatively, the notes on Yahoo Auction seem to be staying on for their duration.
