What is the NY rule?

Our members don't see this ad.
Hey what is the NY rule for applying? I remember sometime ago that there was like a new rule that if you had done x amount of usce or observership you were not candidate or was not able to get state lic. or get into residency
Soemthing like that.
Could anyone share a light about this, thank you.

Caution: New York States 12-Week Clerkship Rule at US Clinical Experiences Blog (USCE List) By Digitaldoc, MD

New York State has a rather curious rule regarding clerkships done during medical school !

This rule states that if a medical student spends more than 12 weeks doing clerkship / elective rotations outside the country of the Medical school, then that student is barred from residency / fellowship training within the state of New York.

Now, IMGs and IMGs-to-be must take special note of this rule, since Residencies in New York state happen to be one of the most IMG-friendly states - I mean you would not want to lose eligibility in that state. Anyways, I don't imagine many IMGs actually getting outside clerkship permissions for more than 12 weeks.

Note:Apparently the rule applies only when you do clerkships WITHIN the state of New York for more than 12 weeks - like clarified by 'Nika' in the comments below - Thanks to Nika for the update, do read the comment below

Who exactly does this rule apply to? There are some Carib students who spend their 3rd and 4th year in NY.

(1) all post graduate trainees prior to entering a postgraduate training program, have received adequate and appropriate medical education as defined in subparagraphs (i) and (ii) of this paragraph:

(i) effective January 1, 1986 and thereafter, hospitals shall permit only the following to be assigned into a postgraduate training position:

(a) a graduate of a medical school offering a medical program accredited by the Liaison Committee on Medical Education or the American Osteopathic Association or registered with the New York State Education Department or by an accrediting organization acceptable to the New York State Education Department; or

(b) a graduate of a foreign medical school who has been certified by the Educational Commission for Foreign Medical Graduates (ECFMG) as meeting the requirements of the ECFMG and has been awarded the ECFMG certificate;

(ii) except for individuals eligible for licensure under section 6528 of the State Education Law, a graduate of a foreign medical school who enrolled in such medical school after October 1, 1983 shall have completed the clinical component of a program of medical education which:

(a) included no more than 12 weeks of clinical clerkships in a country other than the country in which the medical school is located;

(b) included clinical clerkships of greater than 12 weeks in a country other than the country in which the medical school is located if the clinical clerkships were offered by a medical school approved by the State Education Department for the purposes of clinical clerkships;

Basically, if your school is not approved by NY state, you cannot do more than 12 weeks of rotations in NY.

OK so if someone do an USCE for 6months or more. No problem for NY.

I did not know this!!! I got rly lucky then, I did 11 weeks clerkship in California!!! I lucked out... I applied to 19 programs in NY too... good to know for the future though!

Question

Ok I'm still confused on this. I personally know someone who went to a non-NY approved Carib school that got accepted to and started his residency in NY this July. Plus I know I've read on here about students matching into NY programs from non-approved schools.
So what's the deal? Am I confused or is this rule just maybe not enforced?
Oh and the student I know did his rotations in the states (not in the school's country).
