They might change the character a bit, some people insinuated that the bald terrorist leader wearing the ring is going to be back as the Mandarin in the sequel.
The Joker in the Dark Knight is supposed to be more like an Osama Bin Laden type terrorist than a comic book character kind of like Ras al Ghul/Ducard in the last movie. There is nothing more comicy than an ordinary dude with no powers dressing up like a Bat. If you think about it a Superhero like Ironman, his suit has real value. If I had a nuclear powered titanium suit that could fly faster than an F22 that would be cool not gay. After the Matrix and Hancock dissing out costumes, it makes a lot of sense.
