Oral proceeding today. Mississippi state medical board overturned the rule adopting the California and CAAM list.

"This morning American University of Anitgua sent its general counsel, Leonard Sclafani, to appear before the Mississippi State Medical Board to argue against its adoption of a permanent regulation limiting the grant of licenses to practice medicine in the State to graduates of foreign medical schools to those whose schools were approved by the State of California’s medical board or CAAM. Mr. Sclafani is lead counsel in the case brought by AUA and several of its students and graduates against the Arkansas State Medical Board following its stated determination to follow the California Medical Board’s list of approved and disapproved schools for purposes of licensure of IMG’s. After hearing from AUA’s counsel and four other speakers, the Mississippi board voted unanimously to reject the proposed regulation. The Board indicated that it would go back the drawing board to find a means of determining a standard for approval of foreign medical schools. AUA will monitor the Board’s progress and will continue vigorously and affirmatively to prevent the adoption of any rule that would unfairly bar its graduates from practicing medicine in the State of Mississippi or any other State."

Kudos to AUA for sending legal representation to the meeting and to the Mississippi Medical Board for having the wisdom and "intestinal fortitude" to overturn the initial ruling. I only wish the Arkansas Medical Board could be as reasonable!

I was also there. The ruling is actually pushed back so that it will not go into affect until July 2014 allowing anyone that is currently is residency or medical school to obtain a license before then. The board did assure us that there would be something published on the website after the next meeting. It had something to do with submitting it to the secretary of state before it could be posted. All applicants between now and 2014 will be reviewed closely by the board before licensing though.

AUA has filed suit against Arkansas and according to a briefing I watched, our school president and chief counsel indicated that Arkansas was receptive to changes in their new licensing rules. We shall see. I like that MS decided to start over and not base their licensure on CA's arcane rules. If anyone has completed residency and is board certified, they should be allowed to practice in any state.
