Penalty for university of 50,000 guilders per student
20 Aug, 2009, 09:24 (GMT -04:00)
WILLEMSTAD — Non-compliance with the students’ demands by the St. Martinus University (SMU) will cost the institute dearly. The judge attached a penalty of 10,000 guilders per day up to a maximum of 50,000 guilders per student upon non-compliance of the verdict.
The institute, which was also ordered to pay the legal costs of 7200 guilders for the students, has until tomorrow to provide the students with their results and marks. They should receive their transcript on Monday at the latest in order to register elsewhere. The students, who had obtained their bachelor’s degree, should also receive these official papers on Monday at the latest.
This was stated in the detailed verdict, which judge Joost Veerman executed this morning. After the proceedings on Tuesday, he had already announced to ‘flutter the dovecots’ regarding the students’ demands against the university at the Brionplein.
The SMU may hopefully count on the benevolent cooperation if it pays the staff and teachers their outstanding salaries on time. The court holds the SMU entirely responsible for this. “The students have a right to their documents and the argumentation of the teachers is not their concern. The university is responsible if the teachers do not wish to cooperate.”
The students had instituted proceedings as their time is running out. Many medical universities in the Caribbean region are starting with the next semester at the beginning of September. Officially, the verdict applies to the twelve students who went to court. Eleven others had also approached the lawyer, but had not instituted a proceeding, as each student had to pay 450 guilders on court fees. In this respect, the judge gave them the tip that an institute could be established specifically for such matters.
The students and their lawyer expect SMU to fulfill its obligations for the benefit of all (approx. fifty in total) duped students.
